If you are a non-resident alien and your company is not engaged in US Trade or Business, then you can take advantage of the pass-through taxation of an LLC to you personally. A sort of Tax Free LLC.

Delaware is still the best state in the USA to form your company if you don't live in the USA or if you do business in more than one state, or your business is exclusively online.
Better than Wyoming: Delaware provides better protections for shareholders and directors.
Better than Nevada: Delaware doesn't have public records of LLC Members, and it's much cheaper to setup and maintain.

As of Jan 1, 2011 The IRS is now requiring your credit card processor, including PayPal and the like, to report to them how much money you're receiving by accepting credit card, etc. payments they've processed for your business.

The IRS has recently made it very clear that the owner(s) of an LLC have to file an income tax return in the USA. This applies to LLCs formed in every State, not just in Delaware, so you can't form in another State thinking this doesn't apply to you.
